🗳️The CLARITY Act failed 49-50 in September, and its future now depends on who controls Congress.

Here is what each outcome could mean, what the money did, and what to watch.

Polls open in the US today, and for once the biggest crypto story isn't a coin. It's a vote count. I'm not backing any party here. The point is what each result could change for the rules. 🤔

📊 What Is on the Ballot?

All 435 House seats and 35 Senate seats are up for election. Control of each chamber decides committee chairs and which bills get a vote.

📜 Why Crypto Cares

The CLARITY Act would split oversight of digital assets between the SEC and the CFTC and require exchanges to register federally. It passed the House in July 2025 by 294 to 134.

On September 15, a Senate vote to start debate failed 49 to 50, short of the 60 needed, with one senator not voting. Multiple Republicans voted no, and Democrats raised objections over ethics rules about officials' own crypto holdings.

If nothing passes before the new Congress starts on January 3, 2027, the bill expires and has to be reintroduced.

💰 The Money

Reuters counted about $176M in industry-linked election spending through October 20, with roughly $150.8M from Fairshake's network across more than 100 races. Other tallies run higher, and committee transfers can double-count.

Fairshake is backing 32 House incumbents who supported CLARITY, 19 Republicans and 13 Democrats. It also pledged nearly $30M against Democratic Senate candidate Sherrod Brown in Ohio. Fairshake says 53 of the 58 candidates it backed in earlier primaries and special elections won.

Campaign money buys ads, not Senate votes, so what it achieves is still an open question.

🔀 Where Each Side Stands

  • Republicans have been the bill's main champions. A Republican majority in both chambers could bring the text back largely unchanged, but any Senate version still needs 60 votes.

  • Democrats are split. Some negotiated on consumer protection and ethics. Progressives led by Sen. Elizabeth Warren call the bill industry-written, and she says she wants a crypto bill, just not this one.

  • If Democrats take the Senate, TD Cowen's analyst expects Warren to chair the Banking Committee and push tough oversight of regulators.

Prediction markets recently priced an edge for Democrats, with the picture differing by chamber. Those are market odds, not results.

📈 What Might Markets Do?

Analyst Ali Martinez noted that Bitcoin fell 72%, 65%, 52% and 27% after the 2010, 2014, 2018 and 2022 elections. He said himself that this doesn't prove the elections caused the declines.

It's four data points tangled up with the halving cycle, and other analysts expect a rebound once the uncertainty clears. Nobody knows.

⚠️ The Risk Scenario

Whatever the result, headlines can move prices. A split Congress could push crypto rules into 2027 or later, and a unified one could move faster but still needs 60 Senate votes.

A possible December Fed hike adds another layer of volatility on top.

👀 Three Things to Watch Next

  1. Which party controls each chamber, and who chairs the Banking Committee?

  2. Does a motion to reconsider or a lame-duck push revive CLARITY before January 3?

  3. How does Bitcoin trade in the first sessions after the results?

💡 The key takeaway

Today's vote won't change a line of crypto law, but it decides who writes the next one. The CLARITY Act's path now runs through the results, and the outcome could speed it up or slow it down.

The real question isn't who wins. It's whether the next Congress can finish what this one couldn't.

That is the part worth watching.
