⚖️ Uniswap $UNI and a16z Push for DeFi Exemption From Illinois Crypto Tax 🏛️

Imagine moving your own crypto between wallets, only to discover that the transfer could trigger a tax calculation. That is the concern now facing parts of the DeFi industry in Illinois.

Uniswap Labs, venture capital firm a16z, and the DeFi Education Fund are asking Illinois regulators to narrow the scope of the state's proposed digital asset tax rules.

Illinois' Digital Asset Tax Act sets a 0.2% tax on the value of certain digital asset business activities. The draft rules explain how the tax could apply to transactions involving brokers, stablecoins, DeFi services and cross-chain bridges.

The industry groups want wallet withdrawals and cross-chain bridging excluded from value-based taxation. They also oppose requirements to maintain private-key records, arguing that such obligations do not fit how decentralized systems operate.

There is an important distinction: the law targets digital asset business activity involving brokers, not every crypto transfer automatically. The groups are challenging how broadly the rules could be interpreted.

The public comment period ends October 30. Enforcement has already been delayed until July 1, 2027, amid legal challenges, but the underlying dispute remains unresolved.

My take: this is bigger than a tax debate. If ordinary self-custody and blockchain interactions become difficult to classify, compliance uncertainty could discourage innovation and push activity elsewhere.

Should self-custody transfers and decentralized protocols receive explicit protection from transaction taxes?
