Uniswap founder Hayden Adams called Southern District of New York Judge Katherine Polk Failla's comments "founded" following the dismissal of a class-action lawsuit alleging liability for the fraudulent sale of tokens on the decentralized #exchange #DEX
Judge Failla, who is also presiding over the Securities and Exchange Commission's case against Coinbase, dismissed a class-action lawsuit in its entirety against Adams, Uniswap Labs, the Uniswap Foundation, and investors Paradigm, Andreessen Horowitz, and Union Square Ventures. Judge Failla ruled that the software cannot be held liable for users' losses or damages caused to third parties, according to a brief filed Tuesday.
Highlighting several comments from the court, Adams said Wednesday that it was "very motivating to see American courts uphold arguments that I have felt deeply about for years."
“Due to the decentralized nature of the protocol, the identities of fraudulent token issuers are essentially unknown and unknowable, leaving plaintiffs with an identifiable harm but no identifiable defendant,” Judge Failla stated.
