Scilex Holding Co. agreed to pay $150 million in bitcoin in exchange for Datavault AI shares and a pre-funded warrant under a September 2025 agreement. Datavault AI said in an October 26 Form 8-K that an accounting error had made more than a year of financial statements unreliable. Datavault AI determined that the bitcoin should have been recorded as a subscription receivable rather than a digital asset. Management is reassessing whether Datavault AI can continue as a going concern, as collection from Scilex remains uncertain.
