La comunidad de #ArbitrumDAO ha tomado una decisión histórica que pone a prueba la soberanía de las organizaciones descentralizadas frente al sistema judicial estadounidense.
Con un respaldo masivo de más del 90%, los delegados aprobaron liberar 30.765 #ETH (aprox. $71 millones) que habían sido congelados tras el exploit de rsETH del pasado 18 de abril.
El dilema de la propiedad: Mientras que un grupo de familias víctimas del terrorismo de Corea del Norte reclama el ETH alegando que es propiedad del Grupo Lazarus, protocolos como Aave sostienen que los fondos pertenecen a usuarios inocentes y no a los atacantes.
La audaz defensa legal de las víctimas: El abogado Charles Gerstein argumenta que el exploit no fue un "robo", sino un fraude. Bajo esta lógica, los atacantes habrían obtenido la titularidad legal del ETH al engañar al protocolo, convirtiendo técnicamente los fondos en propiedad norcoreana incautable.
Ocho días de tregua forzada: Debido a las reglas constitucionales de Arbitrum (AIP), la transferencia no es inmediata. Existe un periodo de espera de ocho días, una ventana crítica en la que el tribunal de Manhattan podría intervenir para bloquear el movimiento de los activos.
Protección para los delegados: Conscientes del riesgo, la propuesta incluye cláusulas de indemnización para la Fundación Arbitrum, Offchain Labs y los delegados, protegiéndolos contra posibles demandas derivadas de esta ejecución.
El "auto-rescate" de la industria: Linda Jeng (Aave Labs) destaca que, a diferencia de los rescates bancarios tradicionales con dinero público, el ecosistema cripto se está uniendo para compensar a los afectados mediante un esfuerzo coordinado entre Aave, KelpDAO, #LayerZero , EtherFi y Compound.
