Candidate Privacy Notice – Binance

1. Vision and Scope

Binance is committed to protecting the data of job applicants to Binance and its Affiliates and to complying with all applicable Data Protection Laws. This Candidate Privacy Notice (“Notice”) provides information on how Binance (“Binance”, “we” or “us”) collects, uses, stores and discloses your personal data.

For the purpose of the scope of this Notice, candidates mean individuals who apply to an open position with Binance, or who are contacted for or express interest in employment with us, or who attend a recruitment event or undergo an interview or assessment with us. This includes prospective employees, interns and contractors (will be further referred in this Notice as “you”).

For the avoidance of doubt any reference to Binance as Data Controller will include its Affiliates. Affiliates means any company or entity that: (i) controls directly or indirectly a party, (ii) is controlled directly or indirectly by such a party, or (iii) is directly or indirectly controlled by a company or entity, which directly or indirectly controls such a party. This will include companies within the Binance portfolio. “Control” means the possession, directly or indirectly, of the power to direct or cause the direction of management or policies of a person, whether through the ownership of securities or partnership or other ownership interests, by contract or otherwise.

2. Collection and Use of Your Personal Data

Personal data means any information that identifies you or could reasonably be used to identify you, and that is recorded in any form. It includes your name (in English and native languages), address, education, contact details, current job title and employer, LinkedIn Profile, any attachments (such as CV, cover letter), your passport details and the passport details of your dependents (for travel arrangements only), work and personal references and their contact details.

Binance, as Data Controller, collects, processes and uses the personal data you submit through the following channels: Binance Careers website, Binance Mobile Careers website, Job Boards, LinkedIn, other individuals who refer you, background check service providers, recruitment agencies/search firms and Careers Fairs, for the purposes of processing your application as further described below.

Additionally, we may collect and process your personal data from the following publicly available sources, provided collection of the data is necessary and relevant to the performance of the job which you apply for and provided we are allowed to do so by national laws (“direct search”): LinkedIn, Facebook, Twitter and other social media platforms / Google.

We may also process your personal data received from your named referees and or recruitment agencies. Please note that we contact your references with your authorization only. If you provide us personal data about any third party including you references or your family (e.g. as an emergency contact) as part of your application,then you must inform the relevant individuals that you will disclose their personal data to us and present a copy of the information in this Privacy Notice to them.

We will only process information that is relevant to you as a candidate which in some cases might require key strategic validations for skills and professional standing.

3. Background Checks

As part of our recruiting process, we conduct background verifications to our final candidates to check your suitability for the position and our company standards. This process will be carried out by a background check service provider, a third party. For the background checks, you may be required to provide the following information: Full Name, Contact Details, Emergency Contact Details, Current Home Address and Previous Home Address History, Personal Email, Phone numbers, Gender, Date of Birth, Nationality, Signature, Marital Status, Educational Degrees, Previous Work History, References, Driving Citations, Criminal History, Drivers License Number, National Identification Number, National Identity Card Details, Passport Number, Social Security Number, Professional Memberships, Qualifications Certifications, Political Affiliation and Activities (for PEP). The analysis will be based on the position you are applying to, in compliance with data protection laws. We do not require each candidate to provide information relating to each data set listed above, and where applicable, according to the jurisdiction you are in, we may ask for your consent to process this data. Only the data that is necessary will be requested from you.

4. Purposes of and Basis for Processing Your Personal Data

Any personal data you provide to Binance will be used to process your application for the specific position you have applied for. We will use it to: assess your skills, qualifications, and suitability for the role; carry out background and reference checks (when applicable and legally permitted); communicate with you about the recruitment process including interviews in person or remotely; keep records related to our hiring processes; and to comply with legal or regulatory requirements.

In accordance with applicable law, your personal data may be retained and used to process your application for other open positions within Binance and its affiliates which may be suitable, unless you object to such processing in which case your personal data will be deleted.

The processing of your personal data is based on your consent or, in certain cases, the performance of a contract with you (e.g., article 6(1)(a) and 6(1)(b) of the GDPR). We need your personal data in order to conduct the recruitment process, and we will not be able to consider you for a job offer when you do not provide us with your personal data. Any processing of personal data from other sources is based on our legitimate interest (e.g., Article 6(f) of the GDPR). It is in our legitimate interests to decide whether to appoint you to the role since filling the role would be beneficial to our business. We also need to process your personal data to decide whether to enter into a contract of employment with you.

5. Data Retention

We will retain your personal data for a period of 24 months after we have communicated to you our decision about whether to appoint you to the role. We retain your personal data for that period so that we can show, in the event of a legal claim, that we have not discriminated against candidates on prohibited grounds and that we have conducted the recruitment exercise in a fair and transparent way.

If we are currently unable to offer you a position, we will retain your personal data for other open positions, if we believe you might be suitable. We do this based on our legitimate interests. If we retain your personal data for other open positions, we will not store your personal data for this purpose for longer than 2 (two) years.

6. Transfer of Your Personal Data

By submitting your application, you transfer your personal data to Binance and its Affiliates including companies within the Binance portfolio. Your data may be shared with third party providers who are contractually bound to confidentiality for the purpose of the recruitment (including pre-employment checks on prospective employees) as described below, authorities (e.g. Regulators, enforcement body etc.), the referees provided during your recruitment process and/or any legitimate recipient of communications required by laws or regulations and may also be transferred outside the European Union or the European Economic Area. In such a case, Binance will ensure an adequate level of personal data protection, including but not limited to, by entering into standard data protection clauses adopted by the European Commission.

6.1 Use of Third-Party Service Providers

Binance may engage third-party service providers as part of its normal business operations to carry out recruitment-related functions. These service providers include: recruitment agencies/search firms, providers of recruiting software and applicant tracking systems, candidate assessment platforms, interview scheduling platforms, background check companies and hiring analytics platforms. Binance diligently selects such service providers and enters into written agreements with them ensuring that such providers (i) have adopted adequate data protection and security measures to safeguard your personal data; (ii) only use your data as instructed by Binance and for no other purposes; and (iii) store your personal data only within the terms of the agreement. Each third-party service provider guarantees an adequate level of personal data protection, including but not limited to, by entering into standard data protection clauses adopted by the European Commission.

7. Security for Your Personal Data

Binance uses appropriate administrative, technical, personnel, and physical measures to protect your personal data. All electronic data are kept secure on corporate drives with only select authorized individuals having access to the information. Your personal data are also protected through confidentiality undertakings entered into by all persons processing your personal data.

8. Your Privacy Rights

You have the right (i) to request access to your personal data as well as the right to data portability; (ii) to request the rectification of your personal data; and (iii) to request the erasure of your personal data. You also have (iv) the right to object to the processing. When you applied for this role, you provided consent to us processing your personal data for the purposes of the recruitment exercise. You have the right to withdraw your consent for processing for that purpose at any time. Once we have received notification that you have withdrawn your consent, we will no longer process your application and we will dispose of your personal data securely.

9. Failing to Provide Personal Data

If you fail to provide information when requested, which is necessary for us to consider your application (such as evidence of qualifications or work history), we will not be able to process your application successfully. For example, if we require references for this role and you fail to provide us with relevant details, we will not be able to progress with your application.

10. Changes to this Privacy Notice

This Notice will not form part of any potential employment contract and we may change it from time to time. Each version of this Notice is identified at the top of the page by its version date.
