U.S. Senators Berate SEC's Gensler for Agency's 'Unethical' Handling of Crypto Case
The U.S. Securities and Exchange Commission is being targeted with criticism from Republicans on the Senate Banking Committee that oversees the regulator.
The agency has said it's trying to get a handle on its enforcement practices that led to missteps in a court case against a crypto firm, but the lawmakers question what it means for other ongoing cases.
The U.S. Securities and Exchange Commission's admission that it misrepresented evidence in a lawsuit against the blockchain project DEBT Box casts doubt on its wider enforcement practices, several Republican senators argued in a letter to Chair Gary Gensler.
The commission's lawyers had misstated information in court and subsequently failed to correct themselves in accusations against Digital Licensing Inc., known as DEBT Box, that led the court – under the SEC's request – to freeze the company's assets. The agency's lawyers were rebuked by U.S. District Judge Robert Shelby of the U.S. District Court in Utah, and the lawmakers are piling on to chastise the regulator.
"Regardless of whether commission staff deliberately misrepresented evidence or unknowingly presented false information, this case suggests other enforcement cases brought by the commission may be deserving of scrutiny," the lawmakers argued in the letter, dated Feb. 7 and signed by five senators on the Senate Banking Committee, including J.D. Vance (R-Ohio) and Cynthia Lummis (R-Wyo.)
"It is unconscionable that any federal agency – especially one regularly involved in highly consequential legal procedures and one that, under your leadership, has often pursued its regulatory mission through enforcement actions rather than rulemakings – could operate in such an unethical and unprofessional manner," according to the lawmakers, whose committee oversees the securities regulator.
The SEC, which moved to dismiss its case last week, said that "agency officials have taken and are taking broader corrective action to ensure the concerns raised by the court do not arise

Notably, he accumulated 11.9K $ETH ($2.89M) from #Bitfinex at an avg price of $243 in June 2020.

In total, he currently has an estimated profit of $15.56M.

Dormant whale moves millions in ETH to Binance

The whale deposited 4,500 ETH currently worth almost $7 million in fiat to Binance while the coin's price still remained at $1,542.

@OnchainDataNerd pointed out that this whale had purchased 11,900 ETH in total for $2.89 million back in June 2020 on the Bitfinex exchange. Three years ago, the whale paid $243 per Ether, and now the coin's price has gone up by more than six times.

If he sells all his Ethereum bought then now, the profit will constitute $15.56 million, per @OnchainDataNerd's X post.

Among the biggest 100 cryptocurrencies, the top three altcoin gainers of the week are Loom Network (LOOM) at 86.71%, Trust Wallet Token (TWT) at 16.72% and Tether Gold (XAUt) at 5.16%.

The top three altcoin losers of the week are Mantle (MNT) at -17.27%, Rocket Pool (RPL) at -14.39% and Avalanche (AVAX) at -13.39%.

Bitcoin (BTC/USD) encountered improving momentum early in the Asian session as the pair orbited the 27992.79 area, representing the 23.6% retracement of the recent appreciating range from 25983.78 to 28613.37. After trading as low as the 27173.41 area, BTC/USD surged higher to the 28888.88 area, representing a test of the 78.6% retracement of the depreciating range from 28613.37 to 27173.41. Stops were elected above the 28614.25 level, a previous downside price objective related to selling pressure around the 30222 and 29665 levels. Areas of technical resistance and potential selling pressure remain the 28934, 29228, 29665, 29964, 30053, and 30222 levels. Following the ongoing appreciation, areas of technical support and potential buying pressure include the 26988, 26756, 26604, 26318, and 25694 levels.

Further above the market, Stops are cited above the 30178 and 31862 areas. Below the market, Stops are accruing below some downside price objectives including the 24155, 23270, 23204, 23164, 22949, 22028, 21496, 21242, and 20702 areas.
