The Prosecution opposed the motions to dismiss filed by Nicolás Maduro and Cilia Flores based on immunity. In this regard, the Prosecution asks the judge to reject all arguments raised by both defendants and to continue the judicial process.
The action was signed by four prosecutors from the Department of Justice, and was accompanied by an official statement from the Department of State confirming that it does not recognize Maduro and Flores as president and first lady, respectively.

Among other considerations, the Prosecution argues that the United States “does not recognize Maduro Moros as President of Venezuela or Flores de Maduro as First Lady of Venezuela since 2019,” following the “fraudulent presidential elections orchestrated by Maduro Moros in 2018.”
It asserts that together they used those positions in a “fraudulent” manner to “corrupt” institutions and “facilitate” the commission of the crimes for which they are charged in New York.

The Prosecution maintains that the defendants “engaged in ‘conduct aimed at evading, rather than complying with, the applicable law,’ including Venezuelan domestic law,” when they took part in the alleged crimes of cocaine trafficking, narco-terrorism, and weapons described in the indictment. For this reason, “they also cannot invoke immunity based on official acts.”
