Ripple Labs opposes the SEC's attempt to file an interlocutory appeal regarding the summary judgment on XRP's security status. In a letter to U.S. District Court Judge Analisa Torres, Ripple's lawyers argue that the SEC failed to satisfy elements of the Howey test and should wait for a final judgment before appealing. Ripple's chief legal officer, Stuart Alderoty, states that no "extraordinary circumstance" exists to justify departing from normal legal procedure. On July 13, Judge Torres ruled that XRP is not a security, but sales of the token can be securities in certain circumstances.
