🚨 SEC JUST CLEARED UP TWO BIG CRYPTO QUESTIONS
The SEC dropped new crypto FAQs on September 25, and two points are getting a lot of attention 👇
1️⃣ TOKEN BUYBACKS ≠ AUTOMATICALLY A SECURITY
For a functional crypto system, the SEC staff says an issuer announcing a buyback of a non-security crypto asset does not by itself create a promise of managerial efforts.
That means treasury management, supply reduction and protocol-funded burns don't automatically change a token's classification.
2️⃣ LIQUID-STAKING RECEIPTS
A staking receipt token representing ownership of a deposited non-security digital commodity generally isn't treated as a security merely because it represents the staked asset.
The SEC's existing interpretation specifically addresses liquid staking and staking receipt tokens.
Both clarifications remove some of the regulatory uncertainty that has been hanging over crypto projects.
⚠️ Important: These are SEC staff FAQs, not a new law or binding regulation. The SEC says they have no legal force or effect and don't change existing law.
Still, for the crypto industry, clearer rules = less regulatory uncertainty.
