What Exactly Is the Clarity Act?
The Digital Asset Market Clarity Act (H.R. 3633), commonly called the CLARITY Act, is the most significant U.S. crypto market structure bill to date.

Clearly define which digital assets are securities (under the SEC) and which are digital commodities (under the CFTC).
Give the CFTC primary oversight over spot markets for digital commodities.

May 2026: Advanced through the Senate Banking Committee (15–9).
July 2026: A merged Senate version (over 600 pages) was released, including an ethics provision limiting federal officials from profiting from digital assets while in office.
The bill did not pass before the August congressional recess.
On August 8, 2026, Senate Majority Leader John Thune filed a cloture motion, setting up a key procedural vote around September 15.
As of now, the Clarity Act is not yet law. It still needs to clear the Senate (requiring 60 votes), go back to the House if changes are made, and then be signed by the President.
Analysts and prediction markets currently give mixed odds on whether it will actually get signed before the end of 2026. Some put near-term chances relatively low due to limited floor time, remaining disagreements on ethics language, and the upcoming midterms.
