The Financial Times reports that executives at AI companies, including Sam Altman of OpenAI and Dario Amodei of Anthropic, could face multimillion-dollar lawsuits over AI agents that have gotten out of control.
Insurance broker Aon, after reviewing more than 300 legal cases, warned that several types of insurance policies could be at risk, including directors’ and officers’ (D&O) liability insurance.
Verisk expert Tim Rayner suggested that lawsuits could be based on inadequate oversight by company leadership, citing the high-profile Hugging Face hack as an example.
Lawyers, however, point out that there are no direct legal precedents yet: ultimately, executives’ liability will depend on proven losses suffered by shareholders and on how reasonably companies assessed risks in their public statements.
