The U.S. Commodity Futures Trading Commission (CFTC) today advanced “Regulation Crypto Asset Transactions / Markets” to the Federal Register—document number 2026-20888. It’s an ANPRM, or advance notice of proposed rulemaking, not a final rule. The comment deadline is December 14, 2026.
The focus is quite specific: Regulation CTX aims to clarify retail leveraged, margined, and financed crypto commodity transactions (CTX) under Section 2(c)(2)(D) of the Commodity Exchange Act; Regulation CAM, meanwhile, would adapt exchange-style rules for markets that handle these transactions. The published notice repeatedly emphasizes retail leverage—the general framework does not cover ordinary spot trading.
Another data point: Jaret Seiberg of TD Cowen’s Washington research team estimated in a memo that a formal proposal probably won’t arrive before late Q1 or early Q2 2027, and the final rule could be delayed until early 2028. The legislative vacuum remains (Clarity-style legislation has yet to pass), so this looks more like “laying the groundwork using existing authority first”—not something to mistake for full federalization by tomorrow.
For someone like me who focuses only on the facts: the hard facts are that it’s been published in the Federal Register and there’s a 60-day comment period; the timeline is still an analyst’s estimate.$BTC $ETH Retail leverage channels for these assets will follow this framework, but we’re not yet at the stage of having enforceable rules.
