Updates from the U.S. Commodity Futures Trading Commission (CFTC) regarding tokenization of assets guidance: what will change for regulated firms?
On September 24, 2026, CFTC staff updated their frequently asked questions on cryptocurrencies and blockchain technology to address how regulated firms invest customer funds in tokenized assets and use blockchain networks for matters related to regulatory compliance recordkeeping.
The investment guidance covers tokenized issuances of assets that were already permitted. Holders must retain legally and economically equivalent rights.
Blockchain records may also satisfy recordkeeping obligations. For permissionless public networks, companies need controls that enable them to retain and produce records even during outages or other disruptions. This update explains how the existing requirements apply to these activities.
My position: The practical benefit is providing a clearer basis for institutions to assess tokenized products and their compliance systems. Enforceable rights, custody, and reliable recordkeeping remain.
