⚡ From Exchange Control Regulations of 1961 to Crypto Asset Rules of 2026
South Africa is seeking to update the exchange control framework that dates back to 1961.
The proposed regulations for managing capital flows aim to replace those rules and introduce a more modern approach focused on reporting, risk-based supervision, and cross-border capital movements. Crypto assets are addressed in particular because digital assets can move across borders, where the older financial definitions may not apply precisely.
The overhaul is broader than cryptocurrencies: it includes the country’s wider capital flow framework.
But cryptocurrencies have become one of the most closely watched and closely followed elements due to their ability to transfer value internationally.
The initial framework does not mean that South Africa has banned Bitcoin or other crypto assets.
On the contrary, regulators are working on how to fit digital assets within the country’s existing financial oversight structure.
