The company accused the SEC of 'illegally monopolizing' Ethereum. ConsenSys is seeking a federal court declaration that Ethereum is not a security. The company argues that any investigation into ConsenSys based on the idea that Ethereum is a security would 'violate' the company's Fifth Amendment rights and the Administrative Procedure Act.

Furthermore, ConsenSys maintains that MetaMask is not a broker under federal law, and that MetaMask's staking services do not violate securities laws. The company is also seeking a prohibition on the SEC from investigating or taking enforcement action related to MetaMask's exchange or staking functions.
