PANews reported on October 6 that Fox Business reporter Eleanor Terrett disclosed on the X platform that Coinbase has recently filed an interlocutory appeal to the US court, asking the judge to review the US Securities and Exchange Commission's Howey test for the applicability of digital assets. It is reported that Coinbase's initial appeal request was filed as early as early April, when the US Securities and Exchange Commission asked the judge to dismiss Coinbase's appeal, but so far New York Judge Katherine Polk Failla has not yet ruled on the appeal request.

Therefore, Coinb filed another interlocutory appeal and believed that clarifying the applicability of the SEC’s Howey test for digital assets was of “industry-wide significance”. However, according to crypto lawyer James “MetaLawMan” Murphy, interlocutory appeals are rarely approved.
