Following the $6.3B Binance exploit, Senator Cynthia Lummis stated that the stalled CLARITY Act would have given firms the immediate legal cover to freeze funds "the instant law enforcement calls." The bill remains gridlocked in the Senate after a 49-50 vote.

While ecosystem platforms and stablecoin issuers already actively cooperate with law enforcement to freeze billions on-chain without this act, proponents argue formalized safe harbors are necessary to eliminate legal liability and maximize emergency response speed.
