In order for Do Kwon, the former CEO of Terra, to be able to attend the trial that is being brought against him and his former business by the Securities and Exchange Commission (SEC), he is requesting that the trial be postponed.

A formal request has been made by Kwon's legal representative to a court in the United States to postpone the trial because of the concerns surrounding his extradition from Montenegro.

The legal representation of Kwon provided an explanation in a document that was submitted on January 11th, stating that the extradition processes in Montenegro are moving at a slower pace than was expected. As a result of the defense team's argument that Kwon may not be in the United States until February or March at the earliest, the request for a postponement in the trial was made.

Perhaps the Trial Will Begin Without Do Kwon

Kwon's legal representative has suggested that the jury be directed to regard his absence and incapacity to testify as "not unduly prejudicial to him" in the event that the court decides not to postpone the case.

At the moment, the beginning of the trial is expected to take place at the end of January. During the time when Kwon's legal team was successful in appealing a judgment made by the Montenegro high court to extradite him to either the United States of America or South Korea, the extradition procedure began to experience delays. Due to problems with the procedure, the Court of Appeals decided to order a new trial.

During the course of their legal fight in the United States, both Do Kwon and the SEC have submitted requests for summary judgment. Each of the parties is contending that the other side has not provided adequate evidence to support their position, and they are requesting that a federal court rule in their favor without further advancing with the trial.
