Everyone is staring at the chart: $BTC slipped under $84K overnight and $ETH is down ~3% to ~$2,615. But the bigger story this week might be in Washington. Three US moves landed in five days, and together they reshape how crypto is held, traded and reported.
1) FinCEN dropped its wallet and mixer rules (Oct 6)
• The 2020 "unhosted wallet" proposal is withdrawn, with no further action planned. It would have forced banks and exchanges to report and ID the counterparty when you send more than $10,000 to a self-custody wallet, and keep records above $3,000.
• The 2023 proposal that labeled international crypto mixing a "primary money laundering concern" is also withdrawn. FinCEN cited a chilling effect on legitimate activity and a heavy reporting burden, but says it will keep monitoring mixers and may act later.
Why it matters: moving coins from an exchange to your own wallet will not trigger a new federal reporting regime. A clear win for self-custody.
2) SEC approved the first 3x Bitcoin and Ether ETFs (Oct 2)
• Cboe BZX can now list six Volatility Shares 3x products, including a 3x Bitcoin ETF (BITH) and a 3x Ether ETF (ETHK).
• They track three times the DAILY move of futures, not spot coins.
• They are not trading yet: the registration statements still have to become effective, and no launch date is set.
Why it matters: more regulated leverage is coming to US brokerage accounts. Daily-reset 3x products decay in choppy markets, so they suit short-term traders, not holders.
3) SEC proposed new crypto custody rules (published Oct 6)
• New rules on how registered advisers and funds must custody crypto and tokenized assets, including tokenized private funds.
• This is only a proposal. Public comments are due December 7, 2026.
Why it matters: clear custody rules are one of the last blockers for big advisers that still can't easily hold crypto for clients.
The takeaway
Short term, the market trades oil, yields and tonight's Fed minutes. Long term, the US rulebook just got friendlier to self-custody and to institutional products. Price and policy don't always move together.
