🇿🇦 Crypto-Vorschlag aus Südafrika: Solltes Dein eigener Wallet-Account als Auslandsüberweisung gelten?
Südafrika schlägt Regeln vor, die bestimmte Krypto-Überweisungen in seine Kapitalflusskontrollen einbeziehen würden. Treasury und die Reserve Bank haben am 3. August das Entwurfshandbuch veröffentlicht, mit Stellungnahmen bis zum 30. September. Es handelt sich weiterhin um einen Vorschlag, der noch überarbeitet werden kann.
Nach dem Entwurf würden Überweisungen von einem autorisierten inländischen Krypto-Anbieter an einen Offshore-Anbieter – oder an eine Self-Custody-Wallet einer einzelnen Person – als meldepflichtige Kapitalexporte gelten.
Ansässige Privatpersonen könnten diese Überweisungen innerhalb ihrer Devisenkontingente vornehmen. Dieser Auslandsweg wäre für südafrikanische Unternehmen nicht zulässig.
Inlands-Käufe in Rand über autorisierte Anbieter würden diese grenzüberschreitende Meldepflicht nicht auslösen.
🔎 Mein Fazit: Die Definition einer grenzüberschreitenden Überweisung ist genauso wichtig wie die Meldung selbst. Vermögenswerte in eine persönliche Wallet zu verlagern bedeutet nicht zwangsläufig, sie an jemanden im Ausland zu senden – doch die vorgeschlagene Einordnung könnte zusätzlichen Verwaltungsaufwand schaffen.
Für Unternehmen könnten Einschränkungen bei der Berechtigung die Nützlichkeit von Krypto für internationale Abwicklungen begrenzen. Klare Genehmigungen und praktikable Compliance-Prozesse wären entscheidend für Firmen, die Stablecoin-Zahlungen in Betracht ziehen.
Als Nächstes gilt es zu beobachten, wie die Konsultation die Definitionen, Berechtigungsregeln und den Zeitplan für die Umsetzung verändert.
