The U.S. Commodity Futures Trading Commission (CFTC) has issued a new no-action position for providers of passive software, potentially making it easier for crypto applications and wallets to connect users with regulated derivatives markets.

Under the new position, qualifying software providers may facilitate and market software that allows users to trade with CFTC registered futures commission merchants (FCMs), introducing brokers (IBs), and designated contract markets (DCMs) without registering as an introducing broker themselves provided they meet the specified conditions.

The move draws a clearer distinction between software infrastructure and financial intermediation.

A crypto wallet or software platform can potentially serve as an interface that connects users with regulated trading firms and exchanges, while remaining outside the introducing broker registration framework, as long as its activities remain within the conditions outlined by the CFTC.

This approach builds on the CFTC's earlier March 2026 no action relief involving self custodial crypto wallet software.

The decision could create additional opportunities for crypto wallets, trading applications and other technology providers to integrate access to regulated derivatives markets.

For users, it could eventually mean more trading functionality directly inside crypto applications, while the actual regulated trading relationships remain with registered market participants.

However, the relief does not mean that every crypto software developer is automatically exempt from regulation. The CFTC's position applies only when the specified conditions are satisfied.
