This is shaping up to be one of the biggest developments in crypto today.
Senate Republicans have released a new version of the CLARITY Act, just ahead of Tuesday’s critical cloture vote. This appears to be their latest proposal in an effort to secure enough votes to move the bill forward.
Compared with last Thursday’s version, there are four major changes that could materially improve the bill’s chances of passing this year.
The biggest changes are related to ethics:
State Attorneys General would be given authority to enforce three restrictions:
Issuing or endorsing digital assets
Holding a “significant” financial interest
Listing non-compliant assets on exchanges
Covered individuals would be required to divest their holdings or place them into a qualified blind trust, modeled after the 1978 Government Ethics Act.
Civil penalties would be set at the greater of 20% of the transaction value or $500,000, adjusted for inflation.
Effective date: 360 days after enactment, or 60 days after the implementing rules under Section 10102 are issued — whichever comes first.
When Republicans say Trump has agreed to roughly 80% of the Tillis–Gallego proposal, these are the kinds of changes they are referring to.
Importantly, state-level enforcement, which has been a key demand from Democrats, is now explicitly included.
However, three major questions remain unresolved:
How exactly will “significant” be defined?
Will family trusts and indirect ownership count?
Is the 2029 sunset provision still included?
Those three issues could still give Senators Gallego and Alsobrooks enough room to delay or negotiate further.
Stablecoin rewards
On stablecoin yields, the new text allows the Treasury Department to restrict rewards on payment stablecoins if it determines that community banks are experiencing a “material” loss of deposits.
The authority would only last for 18 months.
So this is more of a concession to community banks and certain Republican lawmakers — not a permanent ban on stablecoin rewards.
BRCA / Developer protections
The bill continues to protect developers from being automatically classified as money transmitters or financial institutions.
The protection has also been expanded to include miners and validators, while the reference to 18 U.S.C. §1960 has been removed.
The overall direction is a civil-law safe harbor for developers, rather than a blanket exemption from criminal liability.
Agriculture Committee provisions
The bill also strengthens rules surrounding related-party transactions and conflicts of interest involving digital commodity exchanges and brokers.
It explicitly preserves the applicability of state consumer protection laws.
At the same time, developer protections do not extend to derivatives laws or tribal gaming regulations.
Bottom line
This latest version clearly expands the negotiating space ahead of Tuesday’s cloture vote.
Compared with last Thursday’s text, these are meaningful concessions and could significantly improve the chances of getting enough votes to move the CLARITY Act forward.
However, the key Democratic votes still aren’t guaranteed.
And even if cloture passes on Tuesday, that would only open the door. The bill would still have to navigate the remaining Senate calendar, which is already tight.
For now, the three senators to watch are:

If they say YES, Tuesday’s cloture vote could move from “possible” to “negotiable.”
