美国检察官要求法院驳回 Celsius 前CEO申请的撤销定罪动议，称其法律论点“缺乏依据”

8月19日，纽约南区联邦两名检察官反对 Celsius 前首席执行官的试图说服检察院撤销定罪动议，称其法律论点“毫无根据”，并请求法院在不举行听证会的情况下，直接驳回 Alex Mashinsky 的申请撤销动议。

Mashinsky 于 2025 年 5 月因商品欺诈和证券欺诈被判处12年监禁。今年5月，他告知法庭将进行自行辩护，随后便提交了撤销动议。

本次撤销动议中，包含其对加密货币交易所FTX及其前同事、Celsius前首席营收官Roni Cohen-Pavon的指控，意在争取其在程序上获得案件重新审视的机会。

针对这份申请，检察官提交司法文件予以回击，认为其法律主张缺乏自身无罪的事实申辩支撑，应当不经听证会被直接驳回。

文件指出，Mashinsky既未提交宣誓证词，也未提供新证据。其动议内容仅为重复旧材料、将责任推给第三方，并指责前律师不称职，但文件中未包含任何关于自己无罪的事实陈述。

这起案件要追溯到2022年。当年加密货币市场剧烈动荡，Celsius申请破产，成为继Terraform Labs之后又一家倒下的加密巨头。

早在 2023 年，当局就对 Mashinsky 和前首席营收官 Roni Cohen-Pavon 提起诉讼，两人最终均选择认罪。

其中，Mashinsky于2025年5月因实施商品和证券欺诈被判处144个月监禁，并处罚金4800万美元，另外还和 CFTC 达成 1000 万美元协议和解。

值得注意的是，同案中的被告Cohen-Pavon因向检察官提供了针对Mashinsky的“实质性协助”线索，他已于 5 月被判处服刑期满，已获当庭释放。

目前，负责此案的法官尚未对检察官的驳回请求作出回应。Mashinsky的法律抗争最终能否取得突破，仍有待观察。
