The U.S. Securities and Exchange Commission is preparing a proposed rule under the Investment Advisers Act of 1940 that could allow investment advisers to directly safeguard Bitcoin and other digital assets when qualified custodians are not available.
If introduced and ultimately adopted, the change could expand the operational options available to advisers managing digital-asset exposure for clients. It may also support broader institutional participation by clarifying custody expectations in situations where traditional custody arrangements are limited.
However, the proposal would still need to move through the SEC’s formal rulemaking process, and its final scope, safeguards, and implementation timeline remain uncertain. Digital-asset custody also continues to involve material risks, including cybersecurity, asset segregation, valuation, and regulatory changes.
