The SEC has sent a proposal to rewrite its adviser custody rules for crypto to the White House's Office of Information and Regulatory Affairs, with the submission logged on August 25.

The move revives a regulatory fight the agency lost in 2023, when an earlier attempt would have restricted client crypto to a narrow set of qualified custodians. The new proposal is flagged as deregulatory — a significant shift in direction. Investment advisers, funds, banks and state trust companies are all within scope of the review. October 2026 has been cited as a target deadline, though the specific rule contents have not yet been disclosed publicly.

The custody question — who can legally hold digital assets on behalf of clients — has long been a friction point between crypto firms and regulators. A formal rule could provide clarity for institutional participants operating in the space.
