Custody risk
Assets held in a standard Binance exchange account are custodial. Binance controls the wallet infrastructure and processes the user’s withdrawal request.
This arrangement makes trading and account recovery more convenient, but it also means users depend on the platform’s operational integrity, legal structure and ability to honor withdrawals.
Binance Wallet uses a different self-custody model. Moving funds there changes who is responsible for transaction approval, recovery access, network selection and malicious smart-contract interactions.
Binance Wallet is also legally distinct from the custodial exchange service. Its current disclosure identifies Binance Barbados Limited as the wallet-service provider and states that Binance Wallet is not supervised by the FSRA or another regulatory authority. The regulatory status of a Binance.com exchange entity should therefore not be applied automatically to the self-custody wallet.
Proof of Reserves
Binance publishes Proof of Reserves using Merkle-tree and zero-knowledge verification mechanisms. Eligible users can check whether their recorded balance was included in a reserve snapshot.
🧾 This provides useful evidence about covered customer balances and corresponding on-chain assets at a particular point in time. It does not independently verify:
Every corporate asset.
Every off-chain liability.
Ownership free of all encumbrances.
Internal financial controls.
Future liquidity.
The solvency of every company in the wider group.
Proof of Reserves should therefore be treated as a transparency control, not as a replacement for a complete independent financial-statement audit.
SAFU emergency fund
Binance established the Secure Asset Fund for Users as an emergency reserve for extreme platform incidents. In January 2026, Binance announced that it would convert the fund’s $1 billion stablecoin reserves into Bitcoin and rebalance the fund if its market value fell below $800 million, with the stated aim of restoring it to $1 billion.
Because the fund is denominated in Bitcoin, its market value can change materially. The $1 billion figure is a target described by Binance, not a fixed cash balance or a guaranteed compensation limit.
SAFU is not government-backed deposit insurance, and its existence does not guarantee reimbursement for every security incident, account dispute, trading loss, insolvency event or loss caused by user error.
Security history
In 2019, attackers removed more than 7,000 BTC from a Binance hot wallet. Binance reported that the loss was covered without reducing affected user balances.
The response demonstrated that its emergency arrangements could be used, but the incident also confirms that a large exchange is not immune to security breaches.
Is Binance Legit and Regulated?
Binance operates a real global trading platform through multiple legal entities and holds regulatory permissions in several jurisdictions. Its ADGM framework separates exchange, clearing and custody, and broker-dealer functions through licensed entities.
⚖️ “Regulated,” however, must be qualified. A license held by one Binance entity does not prove that every product is approved in every market, place Binance Wallet under the same oversight or give every user identical legal protection.
The platform also has a significant compliance history. In 2023, Binance entered a multibillion-dollar resolution with United States authorities and pleaded guilty to violations involving the Bank Secrecy Act, operating an unregistered money-transmitting business and sanctions requirements.
The separate SEC civil case was dismissed with prejudice in May 2025. That dismissal prevented the same civil claims from being refiled, but it did not reverse or erase the 2023 criminal resolution.
A balanced review should recognize both the subsequent regulatory developments and the seriousness of the past failures.
Users should identify the contracting entity shown in their account terms and verify whether that entity is authorized for the relevant service in their country.
