Andrew A. Kunsak from law firm Sidley Austin LLP has been granted permission to appear as an investment banker declarant in the ongoing US Securities and Exchange Commission (SEC) v. Ripple Labs lawsuit by Judge Analisa Torres. The banker declarant wants to protect stakeholders from the appeal by the SEC of the summary judgment ruling. Ripple has opposed an investment banker declarant from the same law firm that sided with the SEC, raising concerns for defendants. Meanwhile, Ripple chief legal officer Stuart Alderoty said the SEC is only seeking the court’s permission to file an appeal and not appealing the decision that XRP is a security.
