🇨🇳⚖️ CHINA’S NEW DIVORCE PROPERTY RULES: NO MORE 50/50 SPLIT? NOT SO FAST! 🏠💰

Viral claims suggest that China has abolished the 50/50 division of marital property. But the reality is more complicated.

Effective 1 February 2025, China introduced updated judicial guidelines to clarify how courts should handle property disputes during divorce.

🏠 What has changed?

➤ Property funded by parents: If one spouse’s parents paid for the family home, the court may award the property to their child while requiring reasonable compensation for the other spouse.

➤ Different financial contributions: Courts can consider how much each family contributed, but compensation does not automatically have to follow the exact contribution percentages.

➤ Property owned before marriage: Adding a spouse’s name to a property does not automatically guarantee a 50% share upon divorce.

➤ Non-financial contributions matter: Childcare, household responsibilities, the length of the marriage and each spouse’s circumstances may also influence the court’s decision.

⚖️ The bottom line?

China has NOT abolished the recognition of jointly owned marital property or introduced a blanket rule that spouses can only claim what they personally paid for.

Instead, the updated guidelines provide courts with clearer direction to assess each case based on its specific circumstances.

💡An important lesson for property owners and couples: Marriage involves more than money. Property ownership, parental contributions and family responsibilities can all have legal implications when a marriage ends.

❓**What do you think? Should divorce property be divided equally, based on financial contributions, or according to each couple’s circumstances?
