Foresight News reports that, according to DigitalAsset, the South Korean court has ruled in favor of Dunamu, the parent company of Upbit, in an administrative lawsuit filed against the Financial Intelligence Unit (FIU). The court annulled the FIU's three-month partial business suspension order. The court found that, in the absence of specific enforcement guidelines from the regulatory authorities, Dunamu had taken certain measures, including soliciting commitment letters from customers and self-monitoring. Although the court acknowledged that there is controversy over whether these measures are sufficient to prevent transactions with undeclared operators, under the circumstances of lacking clear guidance, Dunamu has fulfilled its reasonable obligations.
Foresight News previously reported that the Seoul Administrative Court in South Korea has temporarily suspended the 'three-month partial business suspension' penalty imposed by the Financial Intelligence Unit (FIU) on Upbit's parent company, Dunamu, until 30 days after the main case judgment takes effect.
