Senator Elizabeth Warren, one of the crypto industry's most vocal critics in Washington, is expected to become chair of the US Senate Banking Committee when the new Congress convenes in January 2027, according to The Wall Street Journal. The move could bring far greater scrutiny of blockchain companies and crypto firms.

Warren is currently the committee's top Democrat. Republican Tim Scott has chaired the panel since January 3, 2025, while Warren has been its ranking member over the same period. The shift in leadership follows Democratic gains in the midterm elections. The 120th Congress is scheduled to convene on 3 January 2027.

What Warren Could Do as Chair

The committee has wide reach over financial policy. It oversees the Federal Reserve, banks, securities markets and digital assets, and it also covers crypto exchanges, stablecoin issuers and custodians. As chair, she would control which bills the committee takes up, which hearings it holds, and which investigations it opens.

The Journal reported that Warren could use the committee's subpoena powers to investigate alleged insider trading involving prediction markets and examine consumer-protection practices at cryptocurrency companies. She may also scrutinise allegations of corruption involving President Donald Trump and his family. Warren has been among the sharpest critics of Trump family-linked crypto ventures, including the Official Trump token ($TRUMP) and the World Liberty Financial platform.

Subpoena powers are not unrestricted. Senate Banking subpoena rules adopted in 2021 required the ranking member's agreement or a committee majority vote. Industry watchers also note limits on the chair's role. The chair cannot ban cryptocurrencies or impose rules alone.

Impact on the CLARITY Act and Market Structure Rules

The leadership change comes while US crypto market structure legislation remains unsettled. The committee is where federal crypto market structure legislation, including the stalled CLARITY Act, would have to be rewritten. Warren opposes the current Senate version, arguing it falls short on consumer protection, financial stability, illicit finance and sanctions evasion.

Analysts are already positioning for a tougher stance. Investment bank Stifel warned clients that Warren is poised to launch targeted investigations into crypto firms once she holds the gavel. Still, bipartisan agreements on financial crime and consumer protection remain possible.

The appointment is not yet final. Committee assignments will be settled in the coming weeks, but analysts consider a rival bid unlikely, as the few Democratic senators who outrank Warren in seniority are expected to take other gavels. The lame-duck session before the new Congress starts may be the industry's last clear chance to advance market structure legislation under the current committee leadership.
