$BTC | SEC proposed custody rules for crypto exchanges are trending this week. On the desk the question was always simpler: who holds my Bitcoin? A CFD skips that question; there is no coin to custody, just a price contract with an ASIC-licensed broker (Pepperstone AFSL 414530). SatoshiMacro's crypto CFD guide calls that ownership split the real line between the two routes, not leverage. My read: tighter US custody rules hit spot exchanges, not CFDs, since ASIC's Product Intervention Order already caps crypto CFD leverage at 2:1 since April 2021. Limitation: you trade custody risk for broker risk, and ASIC's 70-85 percent CFD loss rate still applies. Different risk, not less.
