Following the partial success of Ripple, Commodities Futures Trading Commission (CFTC) Commissioner Caroline Pham believes that uncertainties are gradually decreasing for crypto regulations in America.

In an appearance on Bloomberg TV on July 17, Pham said recent landmark court decisions on the classification of crypto assets will finally eliminate regulatory uncertainty.

“There is a pretty advanced discussion going on outside of the United States,” Pham said, noting that he has held more than 75 international discussions on crypto regulations. Pham also believes that last year's crypto crisis could have been prevented with clearer laws and public participation.

Ripple's Victory Clarifies Regulations

Pham expressed enthusiasm for participating in regulatory working groups and hopes other US agencies, such as the Securities and Exchange Commission (SEC), will collaborate to take a broad approach to crypto regulations:

“I said last year that the courts would be the first to clarify regulatory uncertainty around the definition of security, and I think we've seen that with some major court opinions issued recently.”

Beyond Ripple, the effects of this decision are being felt on Wall Street and Silicon Valley. It appears that retail investors will not benefit from the investor protections offered to registered investment products. This is “almost implausible,” says Howard Fischer, the SEC’s former senior trial attorney.

Commissioner Pham also touched on the importance of real-world asset (RWA) tokenization. According to him, tokenizing money market funds on blockchain offers “real possibilities” for the modernization of financial markets.

Gary Gensler Dissatisfied with Decision

At a press conference on July 17, SEC Chairman Gary Gensler called this decision regrettable. Gensler had previously claimed that all digital assets, except Bitcoin, are securities; However, his agency has not publicly stated this stance.
