Putting crypto assets in 401(k) plans has finally moved from “warning” to “setting the rules.”
On November 5, the U.S. Department of Labor’s Employee Benefits Security Administration (EBSA) submitted final rule No. 1210-AC38 to the White House Office of Information and Regulatory Affairs (OIRA), where it has entered the White House review stage. The rule aims to clarify the fiduciary duty of prudence when 401(k) retirement plan fiduciaries select investment products, provide a clearer regulatory framework for alternative assets such as cryptocurrencies and private equity to enter retirement portfolios, and reduce related litigation risks for plan administrators.
This represents a new institutional-grade, long-term source of demand, similar to spot ETFs. Major assets such as BTC and ETH are likely to be the first beneficiaries. But don’t treat this as an immediate positive catalyst: the final rule still needs to complete its review and be published, and it will typically include a transition period before taking effect. It will take time for actual capital to flow in, so in the short term, the impact is more likely to be reflected first in a recovery in sentiment.
Two scenarios to watch: first, the final text’s specific restrictions on allocation percentages, custodial qualifications, and due diligence—the clearer the thresholds, the easier implementation will be. Second, the timeline for publication and implementation.
Are you more focused on limits on allocation percentages or custodial qualification requirements?
