After control of the U.S. Congress changed hands, the first verdict on crypto legislation came out today.
Duke University lecturer and crypto regulation researcher Lee Reiners put it bluntly today: the CLARITY Act is dead. The bill passed the House last July by 294 to 134, but stalled at 49 to 50 in a procedural vote in the Senate this September, falling one vote short of advancing. He believes it has little chance of passing during the lame-duck session between the end of the election and the new Congress taking office.
In the same article, Shenandoah University accounting professor Martin Mulyadi offered another perspective: the election doesn’t mean the end of market-structure legislation; it means the next version of the bill will be drafted under the leadership of a different group of people.
There’s another point from Reiners worth noting. He said trading platforms will continue offering their existing products, while the U.S. SEC and CFTC remain led by officials friendly to the crypto industry and are approving an increasingly wide range of products.
The legislative path is blocked, but the executive branch is still moving forward. $BTC is currently trading near $79,600, up 1.9% over 24 hours. The rules haven’t changed; what’s changed is the number of headlines popping up each day.
