Thailand’s SEC plans to issue derivatives licenses to digital asset businesses

The direction of the draft is clear:
Licensed digital asset operators
won’t need to set up a new company
to apply for derivatives-related licenses
covering brokerage, dealing, advisory, and asset management
Exchanges and clearing houses face a separate set of standards
The public consultation runs through November 28

This formally puts digital assets within the scope of the Derivatives Act
It’s not just a casual call to open up leveraged trading
License fees, risk controls, conflicts of interest, and the deadline to commence operations
are all set out in fairly strict terms
Custodians hoping to get into clearing are basically out of luck

Southeast Asia’s compliant market entry points are widening
and getting more expensive
That’s a medium-term positive for regional trading depth
but don’t expect things to take off overnight
Only once the rules are implemented
will local derivatives markets and spot liquidity grow in tandem
