Datavault’s failed BTC withdrawal: the real cause for concern is more than just a negative headline

The hashtag `#DatavaultAI discloses it cannot withdraw Bitcoin from Biconomy` is currently ranked No. 4 on Binance Square’s trending list, with about 20 people discussing it as of 17:48 Beijing time. The event’s direct impact on the price of BTC is limited for now, but it has put the gap between “having BTC on the books” and “being able to control, withdraw, and use BTC” in the spotlight.

## What happened?

In a Form 8-K filed on October 26, Datavault AI said its audit committee had determined that the company’s previously issued financial statements for multiple periods should no longer be relied upon. The company disclosed that it had requested in June 2026 to transfer BTC held in a Biconomy wallet to an external account, but the transfer had still not been completed as of the filing date.

The background to this batch of BTC is also complex: In 2025, Scilex credited 1,309.04 BTC to Datavault’s Biconomy wallet via off-chain transfers. Datavault later transferred 491.431 BTC back off-chain in exchange for approximately $40.5 million in cash. The company’s current preliminary assessment is that the BTC in question does not meet the criteria for recognition as its own digital assets and should instead be treated as a subscription receivable from Scilex. The company expects that total assets for the affected periods may decrease by tens of millions of dollars in aggregate, though the final amount may still be revised.

The official filing also identifies a more significant risk: Management had previously treated these BTC balances as a source of liquidity and must now reassess its going-concern assessment. The timing of the restatement is undetermined, and the internal control review is still ongoing. This cannot simply be described as “BTC was stolen” or “Biconomy misappropriated assets”; the filing does not establish either of those conclusions. The confirmed facts are that the withdrawal was not completed, the accounting treatment needs to be restated, and the related liquidity assessment needs to be revisited.

## What does this mean for the BTC market?

First, spot: As of 17:48 Beijing time, BTC/USDT spot was around $81,546, up 2.360% over 24 hours, with a range of approximately $79,506–$81,823 and quoted trading volume of about 1.009 billion USDT. Spot market: BTC/USDT spot https://www.binance.com/zh-CN/trade/BTC_USDT .

Next, perpetuals: The BTC/USDT USDⓈ-M perpetual mark price was around $81,504, up approximately 2.329% over 24 hours, with quoted trading volume of about 9.082 billion USDT; open interest was approximately 96,350 BTC, and the latest funding rate was about +0.009770%. Perpetual market: BTC/USDT USDⓈ-M perpetual https://www.binance.com/zh-CN/futures/BTCUSDT . Perpetual trading volume being significantly higher than spot volume does not mean there is equivalent new spot buying, and a positive funding rate only indicates that longs are currently paying a cost; on its own, it does not prove a trend reversal.

The local BTCUSDT 4-hour chart shows that the current candle has not yet closed. Price is near the 4-hour MA35 and below the MA99 and MA200; the latest completed 4-hour spot candle closed around $81,082. My assessment is that the Datavault event is more of a warning about “custody, control, and proof of assets” than a sell-off catalyst capable of changing BTC pricing on its own. In the short term, the first thing to watch is whether the $81,800–$81,823 area is confirmed after the close, rather than treating the news headline as a direct indication of market direction.

## How would I validate this assessment?

If BTC continues to rise, we would need to see at least spot trading volume follow through, a 4-hour close holding above the recent high, and no rapid crowding in funding rates alongside growth in perpetual open interest. Conversely, if the price falls back below $80,858 while perpetual OI rises and funding rates continue to climb, that would suggest leveraged longs may be piling in, making the recovery in risk appetite prompted by the event fragile. If Datavault later discloses that the withdrawal has been completed, clarifies ownership of the funds, and reports a restatement impact well below the preliminary estimate, the warning in this article about “control risk” should be downgraded. If more companies or custodians disclose similar issues, the impact could spread from an isolated case to an industry-wide trust issue.
