The NDRC’s new version of the <对外投资管理办法> will take effect in December 2026
The National Development and Reform Commission has released a new version of the <对外投资管理办法>, comprising 76 articles across six chapters, which will take effect on December 1, 2026. The 2017 <企业境外投资管理办法> will be abolished at the same time. The document clearly supports investors to carry out outbound investment according to market principles. Investors are legally entitled to autonomy in outbound investment, with independent decision-making, and they bear their own risks and profits or losses. The view is neutral to slightly cautious: this is not a regulatory document directly targeting crypto assets, but it does redefine the institutional framework for Chinese capital going abroad. For Chinese-backed capital involved in overseas entities, offshore funds, and Web3 and blockchain projects, clearer rules mean compliance pathways become more predictable, but “bearing one’s own profits and losses” also pushes risks entirely back onto investors themselves, narrowing the space that previously depended on policy backstops or gray channels. The real focus is whether filing, approval, and foreign exchange procedures will be simplified in tandem: if outbound channels become smoother, it would be mildly positive for overseas crypto and tech investment by Chinese-backed capital; if approvals become stricter and cycles lengthen, the pace of capital outflow will also slow. The event itself does not involve any specific token and will not directly push BTC or ETH prices in the short term, so holders do not need to rebalance based on it. Key things to watch are the follow-up implementing rules, local supporting policies, and changes in funding pace by Chinese-backed institutions in overseas crypto projects.
