Today, lawyer Ge Zhenhua offered some legal pointers: Sun Yuchen has lived overseas for a long time, so this case may well be considered a foreign-related civil case.
But a foreign-related case doesn’t automatically mean it must be handled by an intermediate people’s court; the two shouldn’t be conflated.
The main event is nationality: China’s Nationality Law does not recognize dual nationality. If someone settles abroad and obtains a foreign passport, their Chinese nationality is automatically revoked.
If he is suing as a Chinese citizen, but his Chinese nationality has already been revoked, his standing as a plaintiff is defective, and the court could directly dismiss the case. If he sues as a foreign national, the case can proceed, but his identity documents and power of attorney must go through “dual authentication”—notarization in the country where he resides, followed by authentication by a Chinese embassy or consulate. Both are required.
