The “compliance implementation phase” for stablecoins has finally moved from legislation to reality.
The U.S. Office of the Comptroller of the Currency (OCC) has released its final rule implementing the GENIUS Act, becoming the first regulator to finalize implementation rules for the Act’s stablecoin provisions. The rule takes effect on January 18, 2027, providing a pathway for banks and nonbank businesses to enter the payment stablecoin market and establishing standards related to foreign stablecoin issuers and asset custody.
On stablecoin rewards, the final rule removes a presumption in the proposed rule that certain commercial arrangements between issuers and third parties could be illegal. However, the statutory prohibition on issuers paying interest directly to stablecoin holders remains in effect. The OCC will review issuer–third-party relationships on a case-by-case basis and may take enforcement action against conduct that circumvents the Act.
Scenario to watch 1: With clearer rules, institutions and payment providers may have fewer reservations about adopting dollar stablecoins. Issuers that market themselves on compliance stand to benefit most directly; in the short term, watch whether USDC’s circulating supply and share of on-chain transfers grow. Scenario to watch 2: Stablecoins with opaque reserves or issuers based in regulatory gray areas face higher compliance and exit costs.
Are you more focused on faster adoption of compliant issuers, or on the pressure for gray-area stablecoins to exit?
