On October 21, 2026, the U.S. Office of the Comptroller of the Currency (OCC) officially published the Final Rule (Bulletin 2026-50) implementing the GENIUS Act. This is a historic step that lays the groundwork for the first federal regulatory framework governing issuers of payment stablecoins in the United States.

With its effective date set for January 18, 2027, this legal framework will directly affect the structure of digital asset circulation, the business models of exchanges, and institutional money flows in the coming cycle.

Unlike previous guidance-oriented proposals, the OCC’s Final Rule establishes exceptionally stringent operating standards:

  • 1:1 Asset Backing & Liquidity Controls: All issuers (including National Banks and licensed non-bank companies) must maintain a minimum daily liquidity reserve of 100% in U.S. dollars or cash equivalents. At the same time, the OCC imposes allocation limits to mitigate counterparty concentration risk.

  • Multinational Oversight Authority: The regulatory framework applies not only to U.S. domestic entities but also extends to Foreign Issuers that wish to continue operating in or access U.S. financial markets.

  • Transparency Mechanisms (Annual Audits): Requires annual independent audits and regular system safety checks.

2. The “Yield Ban” & the Gray Area for Exchanges

The most controversial aspect of the GENIUS Act is its ban on paying interest or yield to Stablecoin holders.

  • The truth about existing reward programs: The OCC confirms that it provides NO “Safe Harbor” for previously established Stablecoin reward or staking programs.

  • Case-by-Case Assessment: Although the OCC has removed its initial negative presumptions regarding arrangements between issuers and third parties (such as crypto exchanges), it says it will assess the substance of each program on a case-by-case basis.

  • Impact: This forces exchanges and yield farming platforms to urgently restructure their products before the January 18, 2027 deadline, or risk legal penalties from federal regulators.

3. Analysis of Market Impact & Digital Dollar Flows

The emergence of the Final Rule under the GENIUS Act brings two opposing but very clear effects:

  1. A Boost for Institutional Capital Standardization (Bullish Long-term): Clear rules from the OCC remove legal risks for traditional banks and large investment funds entering on-chain payment infrastructure. Standardized reserve assets will further strengthen confidence in tokens such as USDC and bank-issued Stablecoins.

  2. Short-term Liquidity Pressure on DeFi (Short-term Friction): The ban on direct yield payments by issuers could reduce the appeal of “depositing Stablecoins to earn passive interest” on financial protocols, redirecting capital toward yield-generating solutions based on RWAs (Real World Assets) or active Derivatives trading.

💡 Strategic Insights for Investors

  1. Watch for divergence among Stablecoins: Stablecoins that comply with OCC standards will have the upper hand in mainstream liquidity and listings on major exchanges. Be cautious of algorithmic Stablecoin models or those with opaque reserve assets.

  2. Get ahead of the RWA & Bank-issued Stablecoin trend: Between now and January 2027, the market will see traditional financial institutions race to expand into Web3 Payments.
