OCC leaves room for stablecoin rewards, but hasn’t endorsed your yield plan

My take: Some reward arrangements now have room to continue, but existing yield programs have not received blanket approval. If you’re using stablecoin rewards to manage idle funds, first check who pays, why they pay, and when payments can stop—not just the annualized rate.

On October 21, the U.S. Office of the Comptroller of the Currency (OCC) issued the final implementing rule for the GENIUS Act. It takes effect on January 18, 2027, and applies to issuers under its jurisdiction and related activities. The publication date and effective date are distinct, and the rule should not be extrapolated into a universal standard for global platforms.

The change: The final rule removed an approach that presumed certain indirect payments to be violations, and instead calls for arrangements to be reviewed individually. But the ban remains on issuers paying interest or yield solely because users hold, use, or retain stablecoins. Having a third party make the payment does not get around the restriction.

At the same time, the OCC did not automatically exempt existing reward programs. Compensation genuinely paid for other services may fall outside the ban, but changing the label or payment channel is not enough to establish compliance.

The American Bankers Association opposed this approach, warning that rewards could draw deposits away from banks. That is a risk assessment by an interested party; it should not be presented as proof that deposits have already flowed out.

For stablecoin holders, I’d treat this news as a prompt to review product terms—not as a reason to count on stablecoin rewards as fixed, long-term interest. Over the next week, watch for platforms to change who makes payments, eligibility requirements, or terms for suspending payments. If regulators clearly approve or restrict a specific type of arrangement, then reassess the sustainability of the corresponding yield program. Don’t generalize from a single case to the entire industry.
