🏛️ U.S. OCC first to finalize stablecoin implementation rules under the GENIUS Act, effective January 18, 2027

October 21 (UTC+8) — The U.S. Office of the Comptroller of the Currency (OCC) has issued its final rule implementing the GENIUS Act, becoming the first regulator to finalize stablecoin implementation rules under the Act. The rule provides a pathway for banks and nonbank companies to enter the stablecoin payments business, and establishes standards for foreign stablecoin issuers and asset custody.

On rewards, the final rule removes a presumption in the proposed rule that “certain business arrangements between issuers and third parties may be unlawful.” However, the statutory prohibition on issuers paying interest directly to holders remains in effect. The OCC will review issuer–third-party relationships on a case-by-case basis and may take enforcement action against attempts to circumvent the Act.

Personal take: The detailed regulations are finally here, so anyone following stablecoin payments and compliance should keep an eye on developments. But the red line against paying interest directly remains. For reward-based arrangements, check whether the specific rules are being followed—don’t judge by the advertised returns alone.
