SEC’s crypto rulemaking comment period ends; regulatory decision looms
With legislation stalled in Congress, administrative rulemaking by the U.S. SEC has become the only substantive path forward. Today, the SEC officially closed the 60-day public comment period on its proposed “crypto asset regulation” rules, receiving about 140 comments.
The debate centers on two key provisions: a “safe harbor” intended to keep token issuers from automatically being deemed to offer securities investment contracts, and an exemption for small offerings. These provisions will directly determine the line between survival and failure for future crypto projects in the U.S., as well as their compliance costs.
Experts say that, with the CLARITY Act facing setbacks in the Senate, the market should no longer expect legislation to deliver comprehensive regulatory certainty. The direction of the SEC’s forthcoming rule text will directly reshape the boundaries for token offerings and compliant trading, making it the regulatory variable most worth watching in the near term.
Let’s discuss in the comments: do you think the SEC’s rules will be favorable or more restrictive?
