The European Union is reviewing the MiCA regulation as part of a consultation that includes a proposal requiring developers of non-custodial Bitcoin wallets to obtain certification before making their software available to the public. According to Odaily, the European Securities and Markets Authority said that open-source software development, self-custody, automated smart contracts, and permissionless infrastructure should not automatically be treated as regulated intermediaries.
The European Securities and Markets Authority also proposed introducing a new regulated service for crypto-asset service providers that enable their clients to access decentralized protocols. The review did not change the existing rules. The European Commission will assess the feedback received and submit a review report under Article 140 of the MiCA regulation by June 30, 2027.
