U.S. regulators have drawn a line for prediction markets.
The CFTC has put forward two proposed rules.
One would include event contracts in the definition of swaps.
The other would carve out entertainment-focused products.
Both were published on the same day.

What’s at stake?
Whether sports event contracts count as derivatives.
Two circuit courts say they fall under state jurisdiction.
A third circuit court ruled that the federal government has jurisdiction.
The disagreement has reached the steps of the Supreme Court.

Who’s paying attention?
Thirty-nine states and more than a hundred tribes have filed briefs.
Professional sports leagues have also joined in.
In August alone, event contracts on regulated platforms saw about $1.5 billion in trading volume.
Sports contracts accounted for 80% of that.

Why does it matter?
Clear classification lets institutions assess risk with confidence.
It also helps compliant platforms price their models.
On-chain prediction markets will have to contend with this framework too.
When the boundaries are unclear, money stays on the sidelines.

For crypto, prediction markets are one of the few on-chain use cases with real demand. The rules will determine who can participate.
