The European Securities and Markets Authority (ESMA) issued an opinion on October 8: crypto-asset service providers authorised under MiCA must stop providing EU customers with services to buy, trade, exchange or otherwise increase their holdings of non-compliant asset-referenced tokens/e-money tokens (stablecoins). The opinion did not name any specific tokens; $USDT, the largest by market capitalisation, has not been authorised under MiCA, nor has $PYUSD. Tether has said it does not currently intend to apply for an EU e-money token licence. Some platforms in the European Economic Area had previously restricted or delisted USDT for EEA users.
National regulators should urge providers to wind down existing holdings as soon as possible, and no later than three months after the opinion was issued—that is, by January 8, 2027. During the transition period, limited services such as selling, exchanging, withdrawing, transferring and custody may continue, but providers must not allow new purchases, promote the tokens, continue trading them or maintain their market supply. EU users who still hold the stablecoins in question on platforms should follow each platform’s subsequent instructions to dispose of them.
