The CFTC hasn’t adopted any rules for crypto. It asked for comments

People are saying in various channels that “the CFTC introduced its first rules” and “recognized BTC, ETH, SOL, XLM, XTZ, and XRP as commodities.” I opened the source:

- On October 5, an ANPRM came out—that’s a request for input before any draft rules
- There are 60 days to comment, starting from publication in the Federal Register
- The coins are examples, “among others,” from an already established taxonomy
- Spot trading without leverage isn’t covered by the rules; at most, it remains subject to fraud oversight

And the “WSJ column” everyone’s sharing was written by CFTC Chair Selig himself.
And he’s honest about it:
Without Congress, they can’t force people to trade on their platforms. And CLARITY failed in the Senate on September 15, 49 to 50.

Plus, the CFTC has had just one commissioner for almost a year. What one person wrote, the next commission can rewrite.

I don’t have $XRP and $BTC , and I’m not making bets here.
In short, for now this is an announcement of an announcement.
