Alito is the second-oldest justice on the bench, and speculation had centered on whether he would step down while Republicans control the Senate and the White House, which would make it easier to confirm a GOP-backed nominee. The article said a Democratic takeover of the Senate after November's midterm election could make confirmation of any Trump nominee difficult or impossible. Justice Clarence Thomas, 78, has also been watched for possible retirement. The Court currently has a 6-3 conservative majority.
