This gap is what the SEC’s proposal this week is meant to address: according to remarks by Chair Paul Atkins, the custody rules under the current Investment Advisers Act of 1940 and the Investment Company Act of 1940 were formed before the internet existed, mainly for traditional assets, and they also require the use of approved custodians. Meanwhile, the ability to provide compliant custody for new assets is often available months after the assets actually list. The proposal would give investment advisers and funds a clear custody pathway. It’s like designating the ports a new route can dock at first.
